These Terms and Conditions are effective from 1 March 2007 until further notice.

Welcome to the Corrective Vision Solutions website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following Terms and Conditions of use, which together with our Privacy Policy govern Corrective Vision Solutions relationship with you in relation to this website.

1. DEFINITIONS

The term Corrective Vision Solutions or “us” or “we” refers to the owner of the website: Corrective Vision Solutions, PO BOX 213, Bexhill-on-sea, TN40 9DA.

The term “you” refers to the user, viewer of our website.

2. TERMS OF USE

The content of the pages of this website is for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on this website is entirely at your own risk, for we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific requirements.

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England and Wales.

3. PATIENT/CUSTOMER AGREEMENT

By submitting your order you warrant, represent and undertake:

  • 3.1 The order is placed for you and you alone and you are not ordering for a third party
  • 3.2 That you are not registered blind or partially sighted
  • 3.3 You are over the age of 16
  • 3.4 Have a valid endorsed prescription by a registered Ophthalmic Optician, OMP and or Contact Lens Practitioner
  • 3.5 The prescription that you enter or supply for Spectacles/Contact lenses is within:

  • a. Two years of your last sight test date if over 16 years of age
    b. One year of your last sight test date if over 70 years of age
    One year of your last Contact Lens aftercare examination
  • 3.6 You will allow us to contact your Optical Practitioner to verify and validate any prescription details supplied by you
  • 3.7 You will provide an original scanned or faxed copy of your Contact Lens specification as verified in accordance with 1.4 before we are able to release your order for Contact Lens products
  • 3.8 You provide us with the following information:
    a. Your gender for the purpose of average of pupillary distance
    b. You are resident in the UK
    c. Any relevant medical history with regard to your Spectacle/Contact lens wear such as allergy’s to metals, diabetes, glaucoma, or any problems you may have experienced with previous Contact Lenses or Spectacles
    d. The products you are purchasing are for your own personal use
    e. You are the credit/debit card holder and the mailing address reflects the delivery address

4. ORDERING PRODUCTS

You must place orders for products via:

When you submit your Order you are confirming:

  • The purchase of the products that you have selected
  • You have read the full terms and conditions of the site
  • 4.5 You have agreed to provisions as set out in sections 1.1 to 1.8 inclusive

With reference to section 4 and its sub-sections Corrective Vision Solutions will confirm receipt of your order via email or verbally if placed over the telephone. This is an acceptance of the contract to supply you with products, which becomes binding once the products have been dispatched to you by us.

You are able to change any details at any time until your order is dispatched to you by contacting us as early as possible via phone, fax or email.

5. LIMITATIONS

5.1 We shall endeavour to fulfil all orders according to our Terms of Supply however we cannot give a 100% guarantee of the availability of products.

5.2 In the unlikely event that a product is not available we will contact you and offer an alternative or a full refund.

5.2.1 If we do not receive a response from you we will assume acceptance of our alternative solution and you will be charged accordingly or at our discretion we will cancel the order and you will be refunded.

5.3 If an order is placed via email, fax or phone and we feel it necessary before processing and completing the order we shall:

5.3.1 Contact you for further information and or clarification on any matters arising with regard to your prescription.

5.3.2 Contact your registered medical practitioner to validate any details we deem necessary to complete your order.

We will not supply any products under the following conditions:

5.4 Single Vision correction that has a combined prescription of over +/-8.00 dioptres and any prescription that has cylindrical powers of more than +/- 2.00 dioptres or if the difference between the right eye prescription and the left eye prescription is more than 1.50 dioptres.

5.4.1 Varifocal lenses, bifocal lenses and enhanced reading or vocational lenses.

5.4.2 If you are resident outside of the United Kingdom.

5.4.3 If your prescription is not valid in accordance with section 1 and all subsections.

We will use an average pupillary distance as set out within the Order section of the site unless:

5.4.4 You provide us with the measurement or upon checking your submitted information advise you to obtain the measurement from the appropriate registered practitioner.

6. TRANSFER OF RISK AND TITLE IN PRODUCTS

The transfer of title will occur when you receive the products and we receive full payment. The transfer of risk in the products will pass on to you when the products are delivered. If the original purchase is cancelled by you then risk in the products will be yours until the products are received by Corrective Vision Solutions.

7. LIABILITY

Nothing in this Agreement shall exclude or limit either party’s liability for death or personal injury resulting from that party’s negligence or for fraud or for any other liability that cannot by law be excluded or limited.

Subject to our Liability Clause the total liability of Corrective Vision Solutions to you in respect of all claims arising out of or in connection with an Order, whether in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, shall not exceed the total sums received by Corrective Vision Solutions for the Goods to which the Order relates.

Corrective Vision Solutions shall not be liable to you for any loss of contracts, loss of income or revenue, loss of profits, loss of goodwill or loss of insurance cover.

Corrective Vision Solutions shall not be liable to you for any consequential or indirect loss of any kind arising out of or in connection with this Agreement however caused and whether arising under contract, tort, negligence, misrepresentation or otherwise. This exclusion shall apply even if Corrective Vision Solutions has been advised of the possibility of such loss or damage.

Corrective Vision Solutions shall not be liable to you where the loss or damage results from information provided by you that is inaccurate, false or misleading or that otherwise result from a breach by you of these Terms and Conditions.

Subject to our Liability Clause Corrective Vision Solutions accepts no liability in respect of any non-standard use of the Goods such as, by way of example only, in extreme sports.

FORCE MAJEURE CLAUSE

Corrective Vision Solutions shall not be liable for failure to comply with these Terms and Conditions owing to any act or event beyond its control.

Force majeure means any circumstances not foreseeable at the date of this contract and not within the reasonable control of the party in question including, without prejudice to the generality of the foregoing, strikes, lockouts, shortages of labour or raw materials, civil commotion, riot, invasion, war, threat of or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural physical disaster, import or export regulations or embargoes, labour disputes.

GENERAL INFORMATION

The headings are for convenience only and shall not affect the interpretation of this Agreement “including” means including without limitation.

You may not assign, sub-contract, sub-license or otherwise transfer in whole or in part any of its rights or obligations under this Agreement.

The Contracts (Rights of Third Parties) Act 1999 and any legislation amending or replacing this Act shall not apply in relation to these Terms and Conditions and nothing in these Terms and Conditions shall confer on any third party the right to enforce any provision of any contract.

These Terms and Conditions and any relevant Order accepted by Corrective Vision Solutions constitute the entire agreement between the parties and supersede any prior written or oral agreements, statements, promises or representations made in relation to the subject matter of such Order (including all other information on the Site subject always to the statutory rights afforded to you as a consumer, each party acknowledges that (save in the case of a fraudulent misrepresentation by the other party) it shall not have any remedy in respect of any representation or term not set out in these Terms and Conditions or any relevant Order accepted by Corrective Vision Solutions.

Terms and Conditions cannot be waived, amended or changed by any representative of Corrective Vision Solutions unless expressly agreed to by Corrective Vision Solutions with you in writing.

Failure by either party to assert its rights in relation to any breach of these Terms and Conditions or any relevant Order on any occasion shall not be deemed a waiver of such rights.

If any provision of these Terms and Conditions and any relevant Order is found to be unenforceable, the remaining provisions shall continue in force subject to such modification as may be necessary to achieve as nearly as possible the objectives of these Terms and Conditions.

These Terms and Conditions and any relevant Order are governed by English law and the parties hereby submit to the exclusive jurisdiction of the English courts in relation to any dispute arising out of them.

Cancellation policy

You may upon notice, in writing to us cancel your order. You may change your order at any time until the dispatch of your order from Corrective Vision Solutions but you must notify us of any change immediately due to the fast processing system that we use.

If you do decide to cancel your order upon receipt of the products you must ensure that the products are returned to us in their original condition as supplied within 24hrs.

We will issue a refund via the same method of which the products were purchased from Corrective Vision Solutions not including any post and packaging costs.

We will ensure that we will reimburse you upon notice of cancellation only to the original purchaser within a 30 day period.

Products cannot be cancelled if you are breach of our Terms and Conditions.

Refunds policy

You have the right to return any goods within 7 days of receipt and a refund will be paid. All refunds will incur a 25% administration charge of the total amount paid for the products.

Once you or your recipient has ordered the product(s) you are bound by our Terms and Conditions (please make yourself aware of these at the time of placing your order).

All refunds will be made to the person who purchased the products and the monies will be refunded directly to the credit or debit card or by the method of payment originally paid to Corrective Vision Solutions. All refunds are processed and take between 5 and 10 working days to show in the purchaser’s account.

To request a refund you MUST return you’re the product via recorded delivery to Corrective Vision Solutions, Customer Services, PO Box 213, Bexhill on sea, TN40 9DA along with a covering letter detailing the reason for your refund request.

The refund will include the total price paid for the products but shall not include any costs of returning the products to Corrective Vision Solutions such as postage and packaging.

If Corrective Vision Solutions has not received full payment for the products no monies will be refunded.

The products MUST be returned to Corrective Vision Solutions in as new condition or no monies will be refunded.

If you breach your obligations under Corrective Vision Solutions Terms and Conditions no monies will be refunded.

Replacements policy

Upon delivery of your products please ensure that they are inspected carefully. In the unlikely event of the products not matching the original specification as ordered or if the products are damaged or missing please do not use the goods for their intended purpose and contact us by email or telephone immediately.

Your product will be accompanied with a copy of your original order and your prescription specification. Please ensure that all information especially your prescription is identical to your original copy. If there are any discrepancies please do not use them for their intended purpose and inform them immediately.

Corrective Vision Solutions will pay the costs of postage packing and delivery if you need to return the products in providing you are not in breach of the our Terms and Conditions.

You will be liable for all costs of posting, packaging and replacement products until such time as the returned good are received by Corrective Vision Solutions.

Delivery policy

We aim to deliver all orders to UK mainland addresses within 14 working days from receipt of order. However, certain products may be on an extended delivery period. We will always advise you of this and await your acceptance before proceeding with your order.

We will endeavour to deliver your goods within the time stated but we will not be liable for any loss caused to you by late delivery. If you do not receive your goods within the stated delivery period please contact us immediately by e-mail or telephone.

On receipt of the goods please inspect carefully for damage and advise us accordingly. Any damages should be advised via e-mail or telephone to us within 24 hours of receipt.

www.correctivevisionsolutions.co.uk is intended primarily for use to UK customers and our charges for UK mainland deliveries are as follows: -

  • Standard delivery is Free for all orders within mainland UK.
  • Next Day delivery charge is £12.00. Saturday Delivery is £30.00.

Notes: Next Day means next working day and excludes weekends and Bank Holidays. Next Day or Saturday deliveries are subject to stock availability and confirmation of the same. If you require Next Day or Saturday delivery we must receive your order before 10 a.m. on the day of despatch.

Deliveries to Northern Ireland, UK Islands and Scottish Highlands may attract an additional delivery charge, but we will always seek your approval of this before processing your order. Deliveries outside the UK will be subject to additional charges, which we will confirm before processing your order.

There may also be delays whilst we arrange suitable shipment. Customers should note that they would be responsible for all import duties and taxes.

Please note: The delivery date specified in the Order Confirmation is an estimate. The place of delivery is as stated in the Order Confirmation.

Corrective Vision Solutions are only able to provide products to customers within the UK mainland only.

Prices and payment policy

All prices stated are in UK pounds sterling. We are unable to accept any other currency at this time. Payment is accepted by Debit or Credit Card and essential checks will be made to ensure that the card holders details including delivery address are correct.

The total price that you will be charged for your products will be clearly stated at the final stage of order processing. Please ensure that these details are correct before proceeding to the checkout.

Corrective Vision Solutions will endeavour to ensure all prices are correct although we cannot guarantee that you will not encounter a incorrectly priced product.

If this is the case we will ensure that you have the choice of either accepting the incorrect or we will offer you the chance to cancel the order.

The postage, packing and delivery charges are set out as in out Delivery Policy.

Privacy policy

This privacy policy sets out how Corrective Vision Solutions uses and protects any information that you give Corrective Vision Solutions when you use this website.

Corrective Vision Solutions is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

Corrective Vision Solutions may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 01 March 2007.

WHAT WE COLLECT

We may collect the following Personal data through the Corrective Vision Solutions website:

  • Navigation data by our web servers or Cookies once you have begun to browse our site
  • Contact information including email address and medical details maybe collected when:
    1) You supply a copy of your prescription either for Spectacles or Contact Lenses in any format (telephone, fax, email and post)
    2) You send us an email
    3) Where you submit an order via the purchase order system
    4) Demographic information such as post code
    5) Other information relevant to customer surveys and/or offers

We will store this personal data as long as deemed necessary to provide our services and goods to you in accordance with our Terms and Conditions and relevant to our Terms and Conditions

WHAT WE DO WITH THE INFORMATION WE GATHER

If you send an email to us through the Site, you will be providing us with information about yourself, such as your email address, and contact numbers and if applicable certain medical information.

This information will not be used other than to responding to your message, answering questions you may have in relation to the order you have placed.

We will ensure that any data collected that needs to be retained is done so on the sites secured servers and systems including the data collected through submission of order forms as below.

ORDER FORM DATA

You are required to submit personal information about yourself as set out in the Order Form, which will include your name and postal address. You are also required to provide information of your spectacle prescription and or contact lens prescription from a Registered Ophthalmic Medical Practioner, Registered Optometrist or Registered Contact Lens Optician.

If you do not wish to register, but would like product and service information, please call us on 08448 00 88 76 or send us an email.

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping
  • We may use the information to improve our products and services
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use this information to customise the website according to your interests.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronical and managerial procedures to safeguard and secure the information we collect online.

We really want your business, so our prices are always keen but in the unlikely event that you find the same product excluding contact lenses (total package including postage and packing) cheaper at the time of purchase we will always try to match the price or even beat it.

We'll match any local (see our Home and Work Visits FAQ) retail competitor's advertised price on every product we sell, either at the time of purchase or within the following 21 days. Our low price commitment covers all new products of the same brand, model number, colour and size that are available, and in stock, at any local retail store. Our commitment applies to on-line retailers but not any auction sites or any one-of-a-kind or other limited-quantity offers, discontinued or close out items, refurbished products, trade-in sales, ‘buy now’ sales and/or special financing.

  • 5) If the criteria in 4) is met the price match guarantee will be applied and any credit/refund due will be applied to the customers original purchasing credit/debit card.
  • 6) The Price match guarantee is intended for use only for the purchaser of the goods, no liability is accepted for any third party, our normal terms and conditions apply for any purchase through our website.
